Risk analysis is a foundational element of compliance with the HIPAA Security Rule and is the essential first step in the process of implementing safeguards to ensure the confidentiality, integrity, and availability of electronic protected health information (ePHI). Through investigations of complaints and data breaches, the HHS’ Office for Civil Rights (OCR) has identified the risk analysis as the most common area of noncompliance with the HIPAA Security Rule, either due to the failure to conduct a risk analysis or not conducting a comprehensive and accurate risk analysis when required. OCR recently launched a new enforcement initiative looking specifically at risk analysis compliance and has imposed 8 financial penalties to resolve risk analysis failures under this enforcement initiative, including 6 of the 7 penalties imposed in 2025. With OCR specifically looking at risk analysis compliance in its investigations of data breaches and complaints, HIPAA-regulated entities must ensure that they are conducting and documenting comprehensive and accurate risk analyses. While risk analyses and risk management are regulatory requirements and essential for safeguarding protected health information, by comprehensively assessing and managing risks, HIPAA-regulated entities will improve their security posture, be able to proactively prevent data breaches, ensure operational integrity, and avoid disruptions to patient care from preventable cyberattacks.
